Labor organization claims Triad Painting underpaid monthly contributions

ST. LOUIS — A labor organization is are suing Triad Painting, Inc., Triad Services, Inc. and their employer Sandra K. Geerling, citing alleged breach of contract.

Painters District Council No. 58, Gregg Smith, David Doerr, Carl Farrell, Mark Borgmann and others filed a complaint on Jan. 24 in the U.S. District Court for the Eastern District of Missouri against the defendants, alleging that they breached their duties of good faith and fair dealing.

According to the complaint, the plaintiffs allege that they suffered monetary damages from the defendants' breached of the provisions of the Collective Bargaining Agreement by underpaying their monthly contributions. The plaintiffs hold Triad Painting, Triad Services and Geerling responsible because theyallegedly failed to fulfill their obligations under the agreement and failed and refused to make the required contributions and dues remissions.

The plaintiffs request a trial by jury and seek judgment against defendant, injunctive relief and to submit all reports, books and records to an audit as well as interest and damages, attorneys’ fees and costs and further relief as the court may deem just. They are represented by Sam K. Gladney of Hartnett Gladney Hetterman, LLC in St. Louis.
