ST. LOUIS — A Festus resident is suing the city of Pevely, as well as patrol officers Charles Anthony Moutray, Kyle Weiss and Brian Benjamin, citing alleged assault, battery and excessive force.
Robert Golden, Jr. filed a complaint on Jan. 25 in the U.S. District Court for the Eastern District of Missouri against the defendants alleging that they caused life threatening injuries, pain and suffering.
According to the complaint, Golden alleges that on Nov. 12 he sustained injuries and damages, which included physical pain and suffering, mental anguish, inconvenience, humiliation, embarrassment, loss of enjoyment of life and stress and incurred medical expenses when the defendants intentionally assaulted and battered him without cause or justification. He holds the city of Pevely, Moutray, Weiss and Benjamin responsible because they allegedly showed callous indifference toward his constitutional rights, acted recklessly and intentionally when they attacked and assaulted him and failed to hire agents that are not abusive of their position.
The plaintiff requests a trial by jury and seeks judgment against defendants, compensatory and punitive damages, costs and other relief the court deems just. He is represented by A. Mick Henderson of Henderson & Waterkotte, P.C. in St. Louis.
