ST. LOUIS — A St. Clair woman is suing Hickinbotham Real Estate, Inc., citing alleged violation of
the Fair Labor Standards Act (FLSA).
Angelia M. Turner filed a complaint on Feb. 1 in the U.S. District Court for the Eastern District of
against Hickinbotham Real Estate, alleging that the Missouri corporation failed to provide employees their rights to proper wages, benefits and incentives.
According to the complaint, Turner alleges that starting November 2013, she suffered damages from the defendant's misclassification of her as an exempt employee. She held the position of a personal assistant/secretary, which involved the performance of non-exempt duties but was not paid overtime for all hours worked over 40 in a given week. She holds Hickinbotham Real Estate responsible because the defendant allegedly misclassified her in direct violation of the labor code, failed to compensate her for all hours worked and deprived her of her rights to overtime pay.
Turner requests a trial by jury and seeks judgment in her favor, declaratory relief, award interest, overtime wages, interest, liquidated damages, costs and attorney’s fees and further relief the court deems just.
