St. Charles County resident accuses Beauty Fit Inc. of breach of contract

ST. LOUIS — A St. Charles County man is suing Beauty Fit Inc., a diet supplements provider, citing alleged fraudulent representation.

Patrick Englert, d/b/a Perfect Health, filed a complaint on March 20 in the U.S. District Court for the Eastern District of Missouri against Beauty Fit Inc. alleging that the diet supplements provider violated the Merchandising Practices Act.

According to the complaint, the plaintiff alleges that between October 2013 and December 2016, he sold the defendant's products on Amazon.com. Because the defendant suddenly revoked authorization to sell the products in January, he is now unable to sell the products purchased from the defendant worth approximately $100,000. The plaintiff holds Beauty Fit responsible because the defendant allegedly revoked his authorization to sell its trademarked products and refused to re-purchase such products or otherwise refund plaintiff's purchase price.

The plaintiff requests a trial by jury and seeks judgment against defendant in excess of $100,000, costs of this action and such other just and proper relief. He is represented by Andrew H. Koor of Suddarth & Koor LLC in O'Fallon.
