ST. LOUIS — Trustee representatives are suing Helfrich Painting Co. and owner Timothy Helfrich for alleged violation of workers' compensation acts.

Painters District Council No. 58, St. Louis Painters Pension Trust, St. Louis Painters Vacation Trust, et al filed a complaint on April 7 in the U.S. District Court for the Eastern District of Missouri against the painting and paper hanging company alleging that the defendants violated the Employee Retirement Income Security Act (ERISA).

According to the complaint, the plaintiffs allege that they have failed to receive accurate amount owed to them by the defendants under agreement and ERISA due to missing reports showing the number of hours worked and contributions at the rate and manner specified in the collective bargaining agreement and trust documents.

The plaintiffs holds Helfrich Painting and Helfrich responsible because they allegedly failed to submit weekly reports and contributions on all bargaining unit employees, failed to remit union dues to the painters and failed to file reports evidencing all hours worked of employees.

The plaintiffs seek all reports and payments to be submitted within seven days after each weekly payroll date, reasonable attorneys' fees, costs and such other further relief as the court may deems just and proper. They are represented by James P. Faul of Harnett Gladney Hetterman LLC in St. Louis.
