ST. LOUIS — Trustee representatives are suing J.L. Brown Contracting Service Inc. and owner Jimmie Brown for alleged violation of workers' compensation acts.

Painters District Council No. 58, St. Louis Painters Pension Trust, St. Louis Painters Vacation Trust, et al filed a complaint on April 7 in the U.S. District Court for the Eastern District of Missouri against the defendants alleging that they violated the Employee Retirement Income Security Act (ERISA).

According to the complaint, the plaintiffs allege that they have failed to receive the accurate amount owed to them by the defendants under agreement and ERISA due to missing weekly reports necessary to determine hours work done and contributions due on its bargaining unit employees at the rate and manner specified in the collective bargaining agreements and trust documents. 

The plaintiffs hold J.L. Brown Contracting Service and Brown responsible because the defendants allegedly failed to submit weekly reports and contributions on all bargaining unit employees, failed to remit union dues to the painters and failed to file reports evidencing all hours worked of employees.

The plaintiffs request all reports and payments to be submitted with seven days after each weekly payroll date, reasonable attorneys' fees, costs and such other further relief as the court may deems just and proper. They are represented by James P. Faul of Hartnett Gladney Hetterman LLC in St. Louis.
