Antennas Direct seeks monetary damages for allegedly false patent infringement claim

ST. LOUIS — An Ellisville-based TV antenna seller is suing Landmark Technology LLC, citing alleged false allegation.

Antennas Direct Inc. filed a complaint on April 28 in the U.S. District Court for the Eastern District of Louisiana against Landmark Technology alleging that it wrongfully accused the plaintiff of patent infringement.

According to the complaint, the plaintiff alleges that as a result of the defendant's bad faith assertion of patent infringement, the plaintiff has incurred monetary damages, including attorneys’ fees and costs. The plaintiff holds Landmark Technology responsible because the defendant allegedly failed to mark its product, wrongfully asserted infringement of the ‘319 Patent and sought royalty payments for the same.

The plaintiff requests a trial by jury and seeks declaration that plaintiff has not infringed any valid and enforceable claim of the ‘319 Patent, declaration that the patent is invalid, award for damages, attorney fees and costs and such other and additional relief. It is represented by Joseph E. Walsh Jr. and Bryan K. Wheelock of Harness, Dickey & Pierce PLC in St. Louis.
