Missouri woman claims debt collector failed to provide correct creditors

ST. LOUIS — A consumer is suing debt collectors, citing alleged misrepresentation in debt collection.

Kim Nicholson filed a complaint on May 5 in the U.S. District Court for the Eastern District of Missouri Eastern Division against Hunter Warfield Inc. and Does 1-4 alleging that the defendants violated the Fair Debt Collections Practices Act (FDCPA).

According to the complaint, the plaintiff alleges that on Aug. 10, 2016, she received a letter from the defendants attempting to collect an alleged debt owed to HSN - Flexpay Dept. The plaintiff claims that HSN - Flexpay Dept. is not a name of any company found by the undersigned or known as part of her creditors. As a result, Nicholson claims she suffered humiliation, anger and emotional distress. 

The plaintiff holds Hunter Warfield and Does 1-4 responsible because the defendants allegedly failed to accurately provide in the letter the name of the creditor to whom the alleged debt owed and failed to effectively inform plaintiff of the identity of the creditor to whom the alleged debt was owed.

The plaintiff requests a trial by jury and seeks judgment for all available damages, plus costs, reasonable attorneys' fees, pre- and post-judgment interest, and such other or further relief in plaintiff's favor as the court deems just and proper. She is represented by Nathan D. Sturycz of Nathan D. Sturycz in Edwardsville, Illinois.
