St. Louis County man claims COBRA benefits terminated without warning

ST. LOUIS — A St. Louis County man is suing health insurance plan providers, citing alleged breach of contract for failing to provide insurance claims.

Anthony Brady filed a complaint on May 8 in the U.S. District Court for the Eastern District of Missouri Eastern Division against St. Louis Public Schools, Group Health Plain of St. Louis Public Schools, Coventry Health and Life Insurance Co., et al alleging that the defendants violated the Public Health Service Act.

According to the complaint, the plaintiff alleges that, in May 31, 2016, after finalizing his divorce from Dana Brady, Anthony Brady had to elect and pay for his COBRA continuation coverage for 36 months because he was still covered as a spousal dependent of Dana Brady in the defendant's group health plan. Anthony Brady elected and paid the applicable premiums to the defendants from June 1, 2016, until October 2016 but was not informed that his COBRA continuation coverage was terminated. 

As a result, Anthony Brady said he incurred substantial medical claims, which were not paid in accordance with the terms of the health plan. 

The plaintiff alleges the defendants failed to provide notice of the termination of his coverage, failed to provide explanation of benefits or a claim denial for claims incurred following the termination and failed to provide a reason for the termination of plan.

The plaintiff seeks an order providing appropriate equitable relief to redress the defendants' violations of the Public Health Service Act and the group health plan and for such further relief as the court deems equitable and appropriate. He is represented by James I. Singer and Matthew B. Leppert of Schuchat, Cook & Werner in St. Louis.
