Citifinancial Servicing accused of telephone harassment in attempt to collect debt

ST. LOUIS — A Clarke County, Mississippi, consumer is suing a St. Charles County-based debt collector, citing alleged violation of telephone harassment statutes.

Jerry Clanton filed a complaint on May 12 in the U.S. District Court for the Eastern District of Missouri Eastern Division against Citifinancial Servicing LLC alleging that the defendant violated the Telephone Consumer Protection Act (TCPA).

According to the complaint, the plaintiff alleges that he received 1,000 calls from the defendant in an attempt to collect an allege mortgage debt. Despite plaintiff's request to stop calling, the calls allegedly continued and were made using automatic telephone dialing system or pre-recorded voice. As a result, Clanton claims he was frequently harassed, his privacy was invaded and he lost time. 

The plaintiff holds Citifinancial Servicing responsible because the defendant allegedly placed non-emergency telephone calls to plaintiff’s cellphone using an automatic telephone dialing system or prerecorded or artificial voice without plaintiff’s prior express consent and despite the request to stop.

The plaintiff seeks judgment for statutory, punitive, actual and treble damages, enjoinder from further violations of these parts and any other relief the court may deem just and proper. He is represented by D. Todd Matthews of Gori Julian and Associates PC in Edwardsville, Illinois.
