Couple claims St. Louis-area corporations, others failed to warn of the effects of asbestos

ST. LOUIS — A couple is suing multiple corporations, some of which are based in the St. Louis area, citing alleged failure to warn and failure to warn individuals of the harmful effects of asbestos.

Edward Diamant and Judy Diamant filed a complaint in the St. Louis 22nd Judicial Circuit Court against Air and Liquid Systems Corp., CBS Corp., Westinghouse Electric Corp., et al. alleging that the defendants failed their duty to exercise reasonable care and caution for the safety of its employees and others working with or around the products.

According to the complaint, the plaintiffs allege that between 1968 and 1970, Edward Diamant was employed as a boiler worker and claims he was exposed to and inhaled, ingested or otherwise absorbed asbestos fibers emanating from certain products of the defendants. Edward Diamant claims he suffers from asbestos-related diseases such as mesothelioma and first became aware of the disease on Oct. 15, 2015, when he was diagnosed with lung cancer. 

The plaintiffs hold the defendants responsible because they allegedly  failed to provide warnings to people working with or around the  products, failed to provide adequate instructions on how avoid inhaling  asbestos and failed to conduct tests on the asbestos-containing  products.

The plaintiffs seek judgment for compensatory damages in excess of $25,000 and for costs, pre and post-judgment interest, and such other and further relief as the court deems appropriate. They are represented by Benjamin R. Schmickle and Matthew C. Morris of SWMW Law LLC in St. Louis.
