CR Drain allegedly failed to submit reports, payment contributions

ST. LOUIS — Trust representatives are suing a plumbing company, citing alleged breach of contract and violation of workers compensation acts.

John O'Mara, Mike O'Laughlin, Mark Collom, Michael J. O'Connell III, et al. filed a complaint June 12 in the U.S. District Court for the Eastern District of Missouri Eastern Division against CR Drain LLC alleging that the defendant violated the Employee Retirement Income Security Act (ERISA).

According to the complaint, the plaintiffs allege they have failed to receive required contributions and dues payments as agreed on the collective-bargaining agreement. Under the terms of the agreement, the defendant is allegedly required to file monthly contribution report forms and to remit dues payments to Plumbers and Pipefitters Local 562. 

The plaintiffs hold CR Drain responsible because the defendant allegedly failed to submit an audit report of its books and records to determine all amounts owed and failed to make required contributions and dues payments under terms of the collective-bargaining agreement.

The plaintiffs seek judgment for contributions owed, dues payments owed, liquidated damages, interest, costs, attorneys' fees and for such other and further relief as the court may consider appropriate. They are represented by Michael A. Evans of Hartnett Gladney Hetterman LLC in St. Louis.
