ST. LOUIS — Trust representatives are suing a construction company, citing alleged breach of contract and violation of workers compensation acts.

St. Louis-Kansas City Carpenters Regional Council, Renee Bell, Ken Stricker, et al. filed a complaint June 13 in the U.S. District Court for the Eastern District of Missouri Eastern Division against Claymont Development LLC alleging that the defendant violated the Employee Retirement Income Security Act (ERISA).

According to the complaint, the plaintiffs allege that they have failed to receive an accurate amount owed to them by the defendant under an agreement and ERISA. This is allegedly due to missing payment contributions on the Pension Trust, the Welfare Trust and Vacation Trust required under the terms of a collective-bargaining agreement and trust documents. 

The plaintiffs hold Claymont Development responsible because the defendant allegedly failed and refused to make all obligated contributions to the funds and to forward to the union all the deducted dues.

The plaintiffs request a trial by jury and seek payment for liquidated damages, submit its books and records for audit and accounting, attorney's fees, costs and such further relief as the court deems just and proper. They are represented by Greg A. Campbell of Hammond and Shinners PC in St. Louis.
