ST. LOUIS — A former patient is suing a medical doctor and health treatment facility, citing alleged negligence during delivery that resulted in permanent damage.

Zacharie I. Pruneau filed a complaint in the St. Louis 22nd Judicial Circuit Court against Dr. Arthur L. Casey and Southside Obstetrics and Gynecology Inc. alleging that the defendants failed their duty to use the degree of skill and learning ordinarily used by agents, employees and representatives in the medical profession.

According to the complaint, the plaintiff alleges that on Sept. 25, 1993, he was born at Lutheran Hospital and was delivered by Casey. The plaintiff claims that during his delivery, medical complications occurred that caused him to be transferred to Cardinal Glennon Hospital where he was treated. 

Since his delivery, Pruneau claims he suffered brain damages, loss of function on the left side of his body and emotional damages. 

The plaintiff holds Casey and Southside Ostetrics and Gynecology responsible because the defendants allegedly failed to properly supervise the plaintiff during delivery, allowed the delivery to proceed in such a way as to deprive the plaintiff of oxygen and did not perform a timely cesarean delivery.

The plaintiff seeks judgment for damages in a reasonable sum in excess of $25,000 together with costs expended and such other and further relief as the court deems just. He is represented by Thomas B. Hayes and Abigail H. Boegeman of The Hayes Law Firm LLC in St. Louis.
