ST. LOUIS — A Jewish congregation is suing an insurance company, citing alleged breach of contract.

Central Reform Congregation filed a complaint June 23 in the U.S. District Court for the Eastern District of Missouri Eastern Division against Affiliated FM Insurance Co. alleging that the defendant violated a contract agreement by denying coverage without reasonable cause or excuse.

According to the complaint, the plaintiff alleges that on April 28, 2012, its property suffered damages due to a hail storm. The plaintiff claims it notified the defendants regarding its active insurance policy for property loss, adding the assessment report of Grayco Roofing Consultants that the property was damaged. Despite the assessment, the plaintiff was denied insurance benefits. 

The plaintiff holds Affiliated FM Insurance responsible because the defendant allegedly failed and refused to pay insurance claim despite plaintiff having an active insurance policy with all conditions have been complied with, met, waived or otherwise satisfied and refused to go to appraisal provision.

The plaintiff requests a trial by jury and seeks judgment for compensatory and consequential damages in an amount in excess of $75,000, pre-judgment interest, costs of action, attorneys' fees and such other and further relief the court may deem just and proper. The plaintiff is represented by Douglas J. Winters of Sher Corwin Winters LLC in Clayton.
