ST. LOUIS — A woman is suing a grocery store, citing alleged negligence in keeping premises safe to avoid harming those inside its premises.

Maria Rodriguez filed a complaint June 27 in the U.S. District Court for the Eastern District of Missouri Eastern Division against GFS Marketplace LLC, doing business as Gordon Food Service, alleging the defendant failed to exercise ordinary care in maintaining the premises in a way to not create an unreasonable risk of harm to others.

According to the complaint, the plaintiff alleges that on May 17, 2014, she was injured when she was walking down the aisle of the grocery store in Maplewood. She claims her leg was cut by an exposed piece of metal on a broken table, which caused her to fall. As a result, Rodriguez claims she suffered severe pain, mental anguish and medical expenses. 

The plaintiff holds GFS Marketplace responsible because the defendant allegedly failed to remove, remedy, or correct the aforesaid dangerous and defective condition and failed to warn customers of the presence of the aforesaid dangerous and defective condition.

The plaintiff requests a trial by jury and seeks judgment for punitive damages in a sum that will serve to punish the stated conduct and other relief the court deems just and proper. She is represented by Christopher R. Dixon of The Dixon Injury Firm in St. Louis.
