St. Louis woman alleges Account Resolution misled her in trying to collect debt

ST. LOUIS — A St. Louis consumer is suing a debt collector, citing alleged misrepresentation in debt collection.

Terrisa Noffsinger filed a complaint June 30 in the U.S. District Court for the Eastern District of Missouri Eastern Division against Account Resolution Corp. alleging that the defendant violated the Fair Debt Collections Practices Act.

According to the complaint, the plaintiff alleges that on Dec. 20, she a received a letter from the defendant attempting to collect a debt to South County Radiologists amounting to $543. The plaintiff claims she called the defendant attempting to gather information about the debt but was allegedly misled when the defendant told her the only way she could get the account out of collections was if she paid the debt in full, entered a payment plan or agreed to settle the debt. 

As a result, Noffsinger said she suffered shame, anxiety and emotional distress. 

The plaintiff holds Account Resolution Corp. responsible because the defendant allegedly used false, deceptive and misleading representation to collect a debt.

The plaintiff requests a trial by jury and seeks judgment for statutory damages of $1,000, actual damages, pre- and post-judgment interest, costs, attorneys' fees and such other or further relief as the court deems just and proper. She is represented by Nathan D. Sturycz in Edwardsville, Illinois.
