Forest West Properties Inc. allegedly failed to take safety measures

ST. LOUIS — An individual is suing Forest West Properties Inc. for allegedly taking insufficient measures to prevent injuries.

Terry Montgomery filed a complaint on July 19 in the St. Louis City Circuit Court, alleging that the property owner failed to keep the property safe to avoid injuring others walking on the premises.

According to the complaint, the plaintiff alleges that he was walking in the defendant's premises on June 12, 2014 when he suddenly and without warning fell in an unprotected, uncovered hole. As a result, Montgomery claims he suffered physical injuries, pain and medical expenses. 

The plaintiff holds the defendant responsible for allegedly failing to adequately maintain and inspect the uncovered hole, failing to adequately warn of the exposed uncovered hole and failing to adequately maintain and inspect the uncovered hole to ensure it was covered and protected.

The plaintiff requests a trial by jury and seeks judgment in an amount exceeding $25,000 for court costs and for other relief the court deems appropriate. He is represented by Robert S. Merlin of Ray B. Marglous PC in St. Louis.
