Passenger alleges he was injured after being hit by another vehicle

ST. LOUIS — A passenger is suing two motorists and a city for alleged negligence in operating vehicles.

Herman Cushman filed a complaint in the St. Louis 22nd Judicial Circuit Court against Dane L. Reinhold, Larry Williams and the city of St. Louis, alleging the defendants failed their duty to operate and maintain a vehicle with the highest degree of care.

According to the complaint, the plaintiff alleges that on July 24, 2012, he was a passenger in a vehicle driven by Williams, a city employee, traveling on South Kingshighway Boulevard when the vehicle was struck in the rear by Reinhold's vehicle. As a result, Cushman claims he suffered physical injuries, stress and loss of personal time. 

The plaintiff alleges the Reinhold failed to keep a proper lookout, and Williams was using a cellphone at the time of the incident and failed to provide proper attention to the operation or progress of the vehicle.

The plaintiff requests a trial by jury and seeks judgment in such amount as is fair and reasonable in excess of $25,000 for costs, interest, and further relief the court deems proper. He is represented by Michael J. Dalton Jr. of Onder, Shelton, O'Leary & Peterson LLC in St. Louis.
