QuikTrip removes bathroom slip-and-fall lawsuit to federal court

ST. LOUIS - QuikTrip wants to fight a personal injury lawsuit against it in federal court.

The company and an unidentified employee of the gas station's location at 9551 Big Bend Boulevard in St. Louis were sued in St. Louis County Circuit Court last year after a Michigan woman allegedly fell and injured herself in the bathroom. 

Plaintiff Brenda Layton stopped at the QuikTrip on December 8, 2018, where she used the restroom. Due to an unseen puddle on the bathroom floor, Layton slipped and fell in the bathroom, injuring her head, back and upper extremities, the suit says.

QuikTrip and the employee on duty at the time of Layton's spill are each sued for at least $25,000 in personal injury damages. QuikTrip removed the case to St. Louis federal court on April 2 under diversity jurisdiction, considering it is an Oklahoma corporation.

The plaintiff is represented by Holloran, Schwartz and Gaertner LLP of St. Louis.
