Chewy granola bars with 'no artificial preservatives' the subject of class action

ST. LOUIS - Robin Boone filed a federal class action lawsuit on Jan. 27 in the Eastern District of Missouri against Pepsico, Inc. and The Quaker Oats Company.

According to the lawsuit, PepsiCo, Inc. and The Quaker Oats Company make and sell Quaker Chewy Granola Bars, which have labeling that says the products contain “No Artificial Preservatives” while the ingredients listed on each item of the product include tocopherols, whose function as an artificial, chemical and/or synthetic preservative.

Boone alleges that because the products in question contain tocopherols, the defendants are being negligent, misleading and fraudulent in the language on the front of the packaging. Boone claims that she and other customers would not have purchased items had the known the items contained preservatives. Boone claims that defendants intentionally and willfully produce false and misleading packaging to increase customer purchases.
