ST LOUIS — St. Charles residents have filed a class-action lawsuit against a carpet cleaning company, citing alleged violation of the Fair Labor Standards Act (FLSA).
Josh Wegat and Jeff Puglisi filed a complaint in the U.S. District Court for the Eastern District of
Prosteam Carpet Care LLC, Gina E. Krohn and James F. Krohn II alleging that they failed to provide employees their rights to proper wages, benefits and incentives.
According to the complaint, the plaintiffs allege that they have suffered loss of earnings for being
misclassified as independent contractors but working more than 40 hours per week but were not paid proper overtime wages by the defendant at the statutory rate of one and a half their regular rate.
The plaintiffs holds the defendants responsible because they allegedly failed to properly apprise employees of their rights under the FLSA, failed to keep or provide an accurate record of its employees' hours worked and failed to compensate its employees for overtime wages.
The plaintiffs request a trial by jury and seek judgment against defendants, unpaid overtime wages, liquidated damages, compensatory damages, attorneys’ fees, costs, interest and other relief as the court deems fair.
