Abatepro failed to contribute to pay all contributions to benefit plans, lawsuit alleges

ST. LOUIS — Trustees of employee benefit plans are suing Abatepro Inc., citing alleged breach of contract.

Greater St. Louis Construction Laborers Welfare Fund, Construction Laborers Pension Trust of Greater St. Louis, et al. filed a complaint in the U.S. District Court for the Eastern District of Missouri against Abatepro Inc. alleging that the Illinois corporation breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs allege that they have suffered substantial losses in earning caused by the defendant's failure to submit its reports and to pay its contributions for September through November and submitted its contributions untimely on several occasions.

The plaintiffs hold Abatepro Inc. responsible because it allegedly failed to fulfill its obligations under the agreement, failed to pay the required contributions and failed to furnish plaintiffs with reports in a timely manner.

The plaintiffs seek judgment against defendant in the amount of $2,304.44 in liquidated damages, interest, order of accounting, costs, accounting fees, attorneys' fees and further relief as the court deems appropriate. They are represented by Janine M. Martin of Hammond and Shinners PC in St. Louis.
