ST. LOUIS — Trustees are suing New Concept Construction Inc., citing alleged violation of Employee Retirement Income Security Act (ERISA).
St. Louis-Kansas City Carpenters Regional Council, Renee Bell, Ken Stricker, Robert Calhoun, Jim Sauer et al. filed a complaint on Feb. 17 in the U.S. District Court for the Eastern District of
against New Concept Construction Inc. alleging that the Illinois corporation breached its duty of good faith and fair dealing.
According to the complaint, the plaintiffs allege that they suffered damages from the defendant's failure to fulfill its obligations under the collective bargaining agreement, including timely payment of its contribution to the funds, forwarding to the union amounts deducted from employees’ paychecks as union dues and furnishing the funds’ offices a monthly statement showing the total number of regular and overtime hours worked by each employee. The plaintiffs hold New Concept Construction responsible because the defendant allegedly failed and refused to make all obligated contributions to the funds and to forward to the union all the deducted dues.
The plaintiffs seek judgment in favor of plaintiffs, delinquent contributions, plus liquidated damages and interest, submit its books and records for an audit and accounting. They are represented by Greg A. Campbell of Hammond & Shinners PC in St. Louis.
