ST. LOUIS — Trust fund representatives are suing J.B. Carpentry Services Inc., citing alleged breach of agreement.
St. Louis-Kansas City Carpenters Regional Council, Carpenters’ Vacation Trust of St. Louis, et al filed a complaint on Feb. 16 in the U.S. District Court for the Eastern District of Missouri against J.B. Carpentry Services Inc. alleging that the remodeling and construction company violated the Employee Retirement Income Security Act.
According to the complaint, the plaintiffs allege that without an audit and accounting, they will be unable to determine the full amounts owed to them by the defendant. The plaintiffs hold J.B. Carpentry Services responsible because it allegedly has failed and refused to make all obligated contributions to plaintiffs' trust funds and to forward to the union all the deducted dues.
The plaintiffs seek judgment against the defendant for its delinquent contributions, plus liquidated damages and interest, an order for defendant to submit its books and records for an audit and accounting, attorneys' fees and'costs and such other additional relief as may be appropriate.
