ST. LOUIS — A former business manager is suing Ascension Health and Sedgwick Claims Management Services Inc., employer and claims administrator, citing alleged breach of fiduciary duty.
Melissa Karcher filed a complaint on March 28 in the U.S. District Court for the Eastern District of Missouri against the defendants alleging that they violated the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that despite her ongoing pain and problems, the defendants terminated her benefits in 2015. She has been damaged for not receiving her benefits under the employee insurance program. The plaintiff holds the defendants responsible because they allegedly repeatedly denied her appeal for her disability benefits and wrongfully dismissed the assertion of her treating physician that she is physically disabled.
The plaintiff seeks damages for all unpaid benefits, plus interest, attorney's fees, costs and for such other relief as this Court may deem just and proper. She is represented by Philip A. Tatlow of Bollweck & Tatlow LLC in Kirkwood.
