ST. LOUIS — Employee benefit plan representatives are suing American Exterior – Interior Services Inc. and Donna Hubbard, employers, citing alleged violation of workers compensation acts.

Painters District Council No. 58, The St. Louis Painters Pension Trust, Gregg Smith, Carl Farrell, Rich Lucks, Daniel Wienstroer, Tim Wies, Fred Phillip Jr., et al filed a complaint on April 5 in the U.S. District Court for the Eastern District of Missouri against the defendants, alleging that they violated the Labor Management Relations Act.

According to the complaint, the plaintiffs allege that as a result of defendants breach of the collective bargaining agreement, they suffered legal, administrative, bookkeeping and accounting fees and costs. The plaintiffs holds the defendants responsible because they allegedly failed to make weekly reports and contributions on all bargaining unit employees who worked for them and failed to remit all required contributions and dues.

The plaintiffs seek judgment against defendants, jointly and severally, for the known principal amount of the delinquency, plus interest, attorneys’ fees and costs and such other just and proper relief. They are represented by James P. Faul of Hartnett Gladney Hetterman LLC in St. Louis.
