Bank of the West alleges St. Peters resident failed to make all payments for boat

ST. LOUIS — A bank is suing a St. Peters resident for alleged breach of contract on an unpaid monthly installment loan.

Bank of the West filed a complaint on April 13 in the U.S. District Court for the Eastern District of Missouri against Todd A. Kussman alleging that the defendant violated the Maritime Commercial Instruments and Liens Act.

According to the complaint, the plaintiff alleges that on March 14, 2008, the defendant purchased a vessel from Midwest Marin Inc. and received a loan from the plaintiff with the principal sum of $43,840, with $401.31 monthly payments. However, bank claims it failed to receive payments amounting to $26,497.18. 

The plaintiff holds Todd A. Kussman responsible because the defendant allegedly failed and refused to cure his past-due obligations under the retail installment contract and security agreement and failed and refused to surrender the vessel.

The plaintiff requests a trial by jury and seeks judgment in personam in the amount of $26,497.18, court costs, placed insurance premiums, attorney fees and such other relief as the Court deems just and proper. They are represented by Laura C. Robinson of Husch Blackwell LLP in Springfield.
