Labor organization representatives claim SEM Construction didn't contribute to trusts

ST. LOUIS — Labor organizations representatives are suing SEM Construction LLC, an employer, citing alleged breach of a trust agreement.

St. Louis-Kansas City Carpenters Regional Council, Carpenters’ Pension Trust Fund of St. Louis, et al filed a complaint on May 18 in the U.S. District Court for the Eastern District of Missouri Eastern Division against SEM Construction LLC alleging that the employer violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that they suffered damages for being unable to determine the full amounts owed to them by the defendant. The plaintiffs hold SEM Construction responsible because the defendant allegedly failed and refused to make all obligated contributions to the pension trust, the welfare trust and the vacation trust funds and failed to forward to the union all the deducted dues.

The plaintiffs seek all unpaid amounts due to the funds, plus interest, liquidated damages, attorneys' fees, costs of this action and all other legal or equitable relief the court deems appropriate. They are represented by Greg A. Campbell of Hammond and Shinners PC in St. Louis.
