Family members accuse St. Louis-area heath care facilities of medical negligence

ST. LOUIS — Family members of a deceased man are suing health care facilities, citing alleged breach of duty and medical negligence in failing to cure a patient.

Maxine Nichols, Cindy Brummer, Eric Nichols and Richard Nichols Jr. filed a complaint May 26 in the St. Louis 22nd Judicial Circuit Court against Barnes-Jewish Hospital, The Washington University, Lorraine Rosenthal, ACNP, et al, alleging that the defendants failed its duty to render that degree of skill and learning ordinarily used by health care providers.

According to the complaint, the plaintiffs allege that, between July 15, 2016, and July 19, 2016, Richard Nichols Sr. suffered from abdominal pain and was transferred to various hospitals. He was not properly diagnosed and treated and died July 21, 2016, the complaint states. As a result, the plaintiffs suffered pain due to the untimely death of a husband and a father and economic loss because of medical and funeral expenses. 

The plaintiffs hold the defendants responsible because they allegedly failed to facilitate the necessary treatment for sepsis, shock and bowel ischemia, failed to consider surgical intervention and failed to obtain urgent surgical consult.

The plaintiffs request a trial by jury and seek judgment in sum in excess of $25,000, together with costs expended, and for such other relief as the court deems just and proper. They are represented by Matthew J. Padberg of Padberg, Corrigan and Appelbaum in St. Louis.
