ST. LOUIS — An individual with a disability is suing St. Peters shopping plaza operators, citing alleged disability discrimination.

Dennis Tooley filed a complaint Aug. 29 in the U.S. District Court for the Eastern District of Missouri Eastern Division against DP Mid Rivers Realty LLC, SSC St. Peters MO LLC and St. Peters Estate Corp., alleging that they violated Title III of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that he was at the defendants' property when he experienced difficulty accessing the goods and utilizing the services. The plaintiff holds the defendants responsible because they allegedly failed to provide accessible parking spaces, accessible ramps, accessible routes and accessible entrances.

The plaintiff requests a trial by jury and seeks an order directing defendants to alter the facility to make it accessible to and useable by individuals with disabilities and to neutralize their policies and procedures towards persons with disabilities, attorneys’ fees, costs and expenses and such other and further relief.
