Postal Service employee claims union dues were improperly withheld

ST. LOUIS — A letter carrier is suing the Postal Service, citing alleged unjust enrichment and violation of workers' compensation acts.

Delbert Jackson filed a complaint Sept. 11 in the St. Louis 22nd Judicial Circuit Court against the U.S. Postal Service and National Association of Letter Carriers (NALC), alleging the defendants are withholding membership fees from his paycheck for union dues from individuals who are no longer employed by the company.

According to the complaint, Jackson alleges that on Oct. 9, 2001, after being promoted as a mail handler, his union dues was transferred to another union. He claims NALC continues to withhold membership fees and USPS has received his membership fees for the past 16 years. 

As a result, Jackson claims he failed to receive any assistance due to the fact that he was not a dues-paying member of his new labor union. 

The plaintiff holds the defendants responsible because they allegedly failed to properly withhold union dues, failed to inform him of the status of his union-membership fees, failed to refund the unauthorized withholding of fees and continues to remit withheld money without authorization.

The plaintiff requests a trial by jury and seeks to award of monetary damages, interest on the wrongfully withheld membership fees, costs, attorney's fees and other relief the court deems proper. He is represented by Christopher B. Bent and Nashad Omar Carrington of Law Offices of Christopher Bent in St. Louis.
