Condo owner claims The Boardwalk COA failed to make timely repairs

ST. LOUIS — A property owner is suing a condominium owners association, citing alleged breach of contract.

Judith Wierciak filed a complaint Sept. 18 in the St. Louis 22nd Judicial Circuit Court against The Boardwalk COA Inc., alleging that the defendant failed to perform its obligation to maintain proper repair and working order of the units.

According to the complaint, Wierciak alleges that on June 17, 2016, her attorney sent a letter to the president of the COA with an invoice for the flooring repairs to the condo amounting to $6,075.36 after water damage was found inside her condo that was allegedly a result of a leaking patio door. The plaintiff claims that she failed to receive checks that should be have been given to her as required by the bylaws of the defendant who is responsible for the repairs for each unit. 

The plaintiff holds The Boardwalk COA responsible because the defendant allegedly failed to make timely repairs and check-ups for each unit and failed to reimburse the plaintiff for out-of-pocket expenses she had to make to keep her flooring from becoming more damaged.

The plaintiff seeks judgment for damages incurred in excess of $25,000. She is represented by Thomas Q. Keefe Jr. of Keefe, Keefe & Unsell PC in Belleville, Illinois.
