Employee claims Subway operators failed to pay her for all hours worked

ST. LOUIS — An employee is suing Subway restaurant operators, citing alleged failure to pay minimum and overtime wages.

Dierdre McPherson filed a complaint Sept. 26 in the St. Louis Circuit Court against Roya Moshiri and Healthy Meal Creations Inc., alleging they intentionally and systematically violated the Missouri Minimum Wage Law.

According to the complaint, the plaintiff alleges that beginning in 2012, she has been financially damaged for not receiving wages for a substantial number of regular and overtime hours that she worked for defendants. The plaintiff holds Moshiri and Healthy Meal Creations Inc. responsible because she claims the defendants allegedly continuously altered and falsified wage and time records, improperly withheld wages from her paychecks and failed to pay her for many of the hours she worked.

The plaintiff requests a trial by jury and seeks unpaid regular and overtime wages, consequential damages and any further relief as the court may deem just and proper. She is represented by Richard A. Voytas and Nathan E. Ross of Ross & Voytas LLC in St. Louis.
