Bicyclist alleges driver who hit him failed to keep proper lookout

ST. LOUIS — A bicycle rider who was hit by a car is suing the motorist, alleging that insufficient measures were taken to prevent injuries.

Charles Weatherspoon filed a complaint on Oct. 30 in the St. Louis Circuit Court against Brian R. Chapman alleging that the motorist failed to exercise the highest degree of care while operating a motor vehicle.

According to the complaint, the plaintiff alleges that on Oct. 29, 2012 he was riding a bicycle on the sidewalk along the south side of Chouteau Avenue approaching its intersection with Mississippi Avenue. As Weatherspoon entered the intersection, the defendant allegedly hit his bicycle. He sustained injuries to his lower back, right wrist, right leg and left knee. 

The plaintiff holds Chapman responsible because the defendant allegedly failed to keep careful lookout, failed to sound his horn or give any signal of his approach, and failed to stop or slow down to avoid hitting him.

The plaintiff requests a trial by jury and seeks damages in excess of $25,000, plus costs expended for this suit. He is represented by Cecil L. Skaggs of Central West End Law Office in St. Louis.
