Geek Hoodies owner allegedly duped

ST. LOUIS — The owner of an online clothing company is suing its previous Australian owners, citing alleged misrepresentations and fraudulent omissions.

Geek Essentials LLC filed a complaint on Nov. 10 in the St. Louis Circuit Court against Sherman Carter PTY Ltd., Digital Tree House PTY Ltd., and others, alleging that they failed to accurately report the payment of a percentage of profits to their online advertising contractor.

According to the complaint, on Dec. 22, 2016 the plaintiff bought Geek Hoodies business and assets from Sherman Carter and the other defendants. Soon after, the plaintiff allegedly realized that the defendants had failed to fully disclose the business' expenses.  As a result of the defendants' conduct, the entire transaction allegedly was rendered valueless and Geek Hoodies shut down.

The plaintiff holds the defendants responsible because they allegedly misrepresented Geek Hoodies' profit and loss statements, and failed to disclose Ubisoft Entertainment's claims of infringement of intellectual property rights.

The plaintiff requests a trial by jury; and seeks damages in a fair and reasonable amount, costs, attorney's fees, pre- and post-judgment interest, and any further relief as the court deems just and proper.
