St. Louis man claims Consumer Adjustment Company violated fair debt collection practices

ST. LOUIS — A St. Louis man is suing Consumer Adjustment Company Inc. d/b/a CACi and Does 1-4, a St. Louis-based debt collector, citing alleged violation of Fair Debt Collection Practices Act (FDCPA).

Edward Bailey filed a complaint on Jan. 12 in the U.S. District Court for the Eastern District of Missouri against the defendants, alleging that they violated FDCPA through abusive, deceptive and unfair debt collection practices.

According to the complaint, Bailey alleges that on Jan. 14, 2016, he has suffered shame, humiliation, anger, anxiety, emotional distress, fear, frustration and embarrassment upon receiving a demand letter from the defendant in its attempt to collect on an alleged debt. While talking to the defendant over the phone, plaintiff was ordered to pay debt immediately in disregard of plaintiff's right to dispute debt within 30 days, the complaint states. 

Bailey holds Consumer Adjustment Company responsible because the defendants allegedly violated the rights of plaintiff to dispute, validate and verify the debt and caused him to pay for counsel fees for advice on his situation.

Bailey requests a trial by jury and seeks judgment against defendant, statutory damages of $1,000, actual damages, interest, costs, attorneys' fees, and further relief as the court deems just. He is represented by Nathan D. Sturycz LLC of Nathan D. Sturycz in Edwardsville.
