ST. LOUIS — A St. Charles County resident is suing Wells Fargo Bank NA and Does 1-24, citing alleged violation of telephone harassment statutes.
Patrick Watts filed a complaint on Jan. 12 in the U.S. District Court for the Eastern District of Missouri against Wells Fargo Bank and Does 1-24, alleging that the financial institution violated the Telephone Consumer Protection Act (TCPA) through intrusive and unwanted calls.
According to the complaint, the plaintiff alleges that he was distraction on the job and suffered from anger, anxiety, emotional distress, fear, frustration and embarrassment from receiving unsolicited and harassing calls from Wells Fargo in its attempt to collect money Watts allegedly owed. He believed Wells Fargo was using an automated telephone dialer system or using an artificial or prerecorded voice and without any prior express consent.
Watts holds Wells Fargo Bank responsible because it allegedly called him with such frequency that meant to abuse or harass, contacted him without express consent and invaded his rights to privacy and seclusion.
The plaintiff requests a trial by jury and seeks judgment against defendant, treble, compensatory, punitive, and other damages, attorneys’ fees and other relief as the court deems proper. He is represented by Nathan D. Sturycz of Sturycz Watts Law in Edwardsville.
