St. Louis Construction Laborers Welfare Fund claims construction firm didn't pay benefits

ST. LOUIS — Trustees are suing Zoie LLC d/b/a Dana Howard Construction, citing alleged breach of contract.

Greater St. Louis Construction Laborers Welfare Fund, Construction Laborers Pension Trust of Greater St. Louis, Brandon Flinn, Danny Jenkins, Corey Black and a number of other plaintiffs filed a complaint on Jan. 18 in the U.S. District Court for the Eastern District of Missouri against Zoie, alleging that the Illinois company breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs allege that they suffered substantial monetary losses because Zoie did not pay fringe benefits to various employee benefit funds and provide monthly report forms for August, October, and November 2014; November 2015 through May 2016; and August and December 2016. The plaintiffs hold Zoie responsible because the company allegedly did not fulfill its obligations under the agreement by failing to pay the required contributions and permit an unbiased audit of their records.

The plaintiffs request a trial by jury and seek judgment against Zoie, an interlocutory order to submit the required employee hours report form and unpaid contributions and order Zoie to submit to financial examination, interest, liquidated damages and pay costs, accounting fees, attorneys' fees and further relief as the court may consider appropriate. They are represented by Janine M. Martin of Hammond and Shinners PC in St. Louis.
