Missouri's Dover IP claims Dover Development Corp. infringed on its trademark

ST. LOUIS — A development company in Missouri and a company in Illinois are suing Dover Development Corp. f/k/a Family Pride Corporation, a Tennessee corporation, citing alleged trademark infringement.

Dover IP and and Dover Development, LLC  filed a complaint on Jan. 19 in the U.S. District Court for the Eastern District of Missouri against Tennessee-based Dover Development Corporation, alleging that the Tennessee corporation adopted marks in bad faith and with intent to cause confusion and dilution.

According to the complaint, Dover IP and Dover Development allege that Dover Development continues to seek financing and development opportunities for its ongoing senior living realty projects and has invested a substantial amount of time, effort and resources in promoting and identifying its business under the trade name "Dover Development." However, Dover IP and Dover Development continue to suffer damages as a result of Dover Development's use of the trademark and trade name in commerce without plaintiffs' consent or license.

The plaintiffs hold Dover Development responsible because the defendant allegedly caused confusion among consumers by offering similar services and using the same marks as Dover IP to capitalize and receive the benefit of the plaintiff's reputation and goodwill.

Dover IP and Dover Development request a trial by jury and seek judgment against defendant, enjoined from using the infringing mark, compensate plaintiff for defendant's infringing activities, treble damages, attorneys’ fees, costs, interest and further relief as may be proper. They are represented by Gregory C. Mollett and Clark W. Hedger of Greensfelder, Hemker & Gale PC in St. Louis.
