ST. LOUIS — A Hazelwood woman is suing Online Information Services Inc. d/b/a Online Collections, citing alleged violation of the Fair Debt Collection Practices Act (FDCPA).
Ruth Pennell filed a complaint on Jan. 23 in the U.S. District Court for the Eastern District of Missouri against Online Information Services, alleging that the debt collector violated FDCPA through abusive, deceptive and unfair debt collection practices.
According to the complaint, the plaintiff alleges that on June 22 she examined her credit report, which showed an alleged debt that she had disputed with the defendant remains, despite sending the debt collector a dispute letter on April 14, months before the defendant re-reported the alleged debt. The plaintiff holds Online Information Services responsible because the company allegedly reported on an alleged debt even though it was in dispute, which caused a negative mark on Pennell's credit standing.
Pennell requests a trial by jury and seeks judgment against Online Information Services, actual and statutory damages, attorney's fees, costs, declaratory relief, expenses, disbursements and further relief as may be just.
