Van Buren man claims he didn't authorize draft payments in collections

CAPE GIRARDEAU — A Van Buren resident has filed a lawsuit against Professional Credit Management, Inc., citing alleged violation of the Fair Debt Collection Practices Act (FDCPA).

Curt Majors filed a complaint on Jan. 24 in the U.S. District Court for the Eastern District of Missouri against Professional Credit Management, alleging that the debt collector violated FDCPA through abusive, deceptive and unfair debt collection practices.

According to the complaint, Majors alleges that on March 21 he suffered damages from receiving a deceptive collection letter from the defendant on behalf of the original creditor, Black River Medical Group. The letter included collection costs for credit and debit card and/or bank draft payments, which were not authorized by the agreement, creating the debt or permitted by law. Majors holds Professional Credit Management responsible because the defendant allegedly attempted to collect an amount Majors doesn't owe against loan agreement or under the law.

Majors requests a trial by jury and seeks judgment against defendant, actual and statutory damages, attorney's fees, costs, expenses, disbursements and further relief as the court may deem proper. He is represented by Yaakov Saks of RC Law Group, PLLC in Hackensack, New Jersey.
