ST. LOUIS — A Ballwin man is suing Convergent Outsourcing, Inc., citing alleged violation of the Fair Debt Collections Practices Act (FDCPA).
Jeffrey Martinez filed a complaint on Jan. 24 in the U.S. District Court for the Eastern District of Missouri against Convergent Outsourcing, alleging that the debt collector violated FDCPA through abusive, deceptive and unfair debt collection practices.
According to the complaint, Martinez alleges that on Feb. 26, he suffered damages from receiving a deceptive collection letter from the defendant that does not indicate important information about the alleged debt. According to the complaint, it did not include an accurate reflection of principal amount and interest and invoked the Internal Revenue Service. The plaintiff holds Convergent Outsourcing responsible because the defendant allegedly failed to provide an accurate and lawful collection letter, caused the plaintiff to suffer from a false and deceptive collection letter and caused the plaintiff to retain and pay for counsel.
Martinez requests a trial by jury and seeks judgment against defendant, actual and statutory damages, attorney's fees, costs, declaratory relief, expenses, disbursements and further relief as may be deemed just. He is represented by Yaakov Saks of RC Law Group, PLLC in Hackensack, New Jersey.
