ST. LOUIS — A St. Louis woman is suing Enhanced Recovery Company, LLC and Does 1-4, citing alleged violation of the Fair Debt Collections Practices Act (FDCPA).
Paris Wheeler filed a complaint on Jan. 27 in the U.S. District Court for the Eastern District of Missouri against the defendants, alleging that they violated FDCPA through abusive, deceptive and unfair debt collection practices.
According to the complaint, Wheeler alleges that on Feb. 15, she suffered damages upon receiving a letter from the defendants attempting to collect an alleged debt. The letter allegedly stated that she had 30 days to dispute the debt; however, when she called the defendants within that period to gather information about the debt, the defendants demanded that she pay the debt immediately, plus an additional $12.95 as convenience fee, against her statutory rights, which further caused her to suffer humiliation, anger, anxiety, fear, frustration and embarrassment. She holds Enhanced Recovery Company and Does 1-4 responsible because the defendants allegedly concealed plaintiff's dispute, validation and verification rights and unlawfully demanded a convenience fee on top of the actual debt.
Wheeler requests a trial by jury and seeks judgment against defendants, statutory damages of $1,000, actual damages, interest, costs, attorneys’ fee and further relief in plaintiff’s favor as the court deems just.
