St. Charles woman says Transworld Systems was abusive in pursuing debt

Late 06

ST. LOUIS — A St. Charles resident is suing Transworld Systems Inc, citing alleged violation of the Fair Debt Collection Practices Act (FDCPA).

Kayla Sanders filed a complaint on Feb. 2 in the U.S. District Court for the Eastern District of Missouri against Transworld Systems, alleging that the debt collector violated FDCPA through abusive, deceptive and unfair debt collection practices.

According to the complaint, the Sanders alleges that on May 8, she was harmed as a result of a letter from the defendant attempting to collect a debt of $653. Subsequently, Sanders called the defendant to ask about the debt, but the defendant demanded that she pay immediately even though plaintiff’s 30-day validation period would not expire until June 8. As a result, she suffered shame, humiliation, anger, anxiety, emotional distress, fear, frustration and embarrassment. Sanders holds Transworld Systems responsible because the defendant allegedly failed to identify the creditor to whom the debt is owed and failed to regard plaintiff's dispute, validation and verification rights.

Sanders requests a trial by jury and seeks judgment against the defendant, statutory damages of $1,000, actual damages, interest, costs, attorneys’ fees and further relief as the court deems just. She is represented by Nathan D. Sturycz in Edwardsville, Illinois.
