Class-action suit claims Medicredit violated phone, debt collection acts

ST. LOUIS — A man has filed a class-action lawsuit against St. Louis-based Medicredit, Inc. and Tennessee-based Parallon Business Solutions, LLC, citing alleged violation of telephone harassment statutes.

Todd Hornberger filed a complaint on behalf of himself and others similarly situated on Feb. 3 in the U.S. District Court for the Eastern District of Missouri against the defendants, alleging that they communicated through unlawful means in violation of the Telephone Consumer Protection Act and the Fair Debt Collection Practices Act.

According to the complaint, Hornberger alleges that he and others suffered an invasion of privacy, an intrusion into their lives and a private nuisance from receiving incessant calls from the defendants in their attempt to locate an unknown third party. The defendants were informed that they had the wrong number and demanded to cease all calls but continued to call Hornberger using an automatic telephone dialing system, the complaint states. Hornberger holds Medicredit and Parallon Business Solutions responsible because they allegedly insisted on making calls to wrong or reassigned telephone numbers, utilized an automatic telephone dialing system and failed to acquire any prior express consent before calling.

Hornberger requests a trial by jury and seek judgment in favor of the plaintiffs, designate Hornberger as class representative, enjoin defendants from continuing to place calls, actual damages or statutory damages, costs, expenses, attorneys’ fees and further relief as the court may deem just. The plaintiffs are represented by Anthony LaCroix of LaCroix Law Firm, LLC in Kansas City and Michael L. Greenwald of Greenwald Davidson Radbil PLLC in Boca Raton, Florida.
