ST. LOUIS — A St. Louis woman is suing Dyck-O’Neal, Inc. and Does 1-4, citing alleged violation of Fair Debt Collection Practices Act (FDCPA).
Sadija Osmanovic filed a complaint on Feb. 2 in the U.S. District Court for the Eastern District of Missouri against the defendants, alleging that they violated FDCPA through abusive, deceptive and unfair debt collection practices.
According to the complaint, Osmanovic alleges that on March 11, she suffered damages, including shame, humiliation, anger, anxiety, emotional distress, fear, frustration and embarrassment, from receiving collection letters from the defendant. The letter deceptively failed to indicate that the company was trying to collect increasing amounts of interest on the debt. Osmanovic holds Dyck-O’Neal and Does 1-4 responsible because they allegedly failed to state the principal amount of the debt and attempted to collect an amount not authorized by law or the loan agreement.
Osmanovic requests a trial by jury and seeks judgment in her favor, statutory damages of $1,000, actual damages, interest, costs, attorneys’ fees and further relief as the court deems just. She is represented by Nathan D. Sturycz in Edwardsville.
