St. Louis County man alleges North Oaks Group hasn't complied with ADA rules

ST. LOUIS — A St. Louis County man is suing North Oaks Group, Inc., citing alleged failure to uphold Americans with Disabilities Act (ADA) regulations.

Malcolm Johnson filed a complaint in the U.S. District Court for the Eastern District of Missouri against North Oaks Group, alleging that the St. Louis property owner breached its duty of good faith and fair dealing.

According to the complaint, Johnson alleges that he experienced serious difficulty accessing the goods and utilizing the services at the defendant's property because of architectural barriers that hinder people with disabilities. Johnson suffers from chronic obstructive pulmonary disease, arthritis and osteoarthritis, for which he requires an electric scooter, a wheelchair or a walker, the complaint states.

Johnson holds North Oaks Group responsible because the defendant allegedly failed to provide an accessible-designated parking spaces, failed to provide an access aisle with permissible width, and failed to modify the barriers to serve all invitees and comply with the provisions of the ADA.

Johnson requests a trial by jury and seeks judgment against defendant, declaratory and injunctive relief, attorneys' fees, costs and expert fees, and further relief as the court deems necessary. He is represented by Garret S. DeReus of Bizer & DeReus in New Orleans.
