ST. LOUIS — A Wright City man is suing Citibank NA, citing alleged violation of telephone harassment statutes.
George E. Hahn Jr. filed a complaint on Feb. 7 in the U.S. District Court for the Eastern District of Missouri against the debt collector alleging that it violated the Telephone Consumer Protection Act (TCPA) through intrusive and unwanted calls.
According to the complaint, the plaintiff alleges that in December he suffered from distraction, embarrassment, annoyance, loss of sleep and unavailability of telephone line because of Citibank's incessant calls to attempt to collect on an alleged debt. Despite not having consent, the defendant continued to call and further annoyed Hahn by its use of an autodialer, or an artificial or prerecorded voice. Hahn holds Citibank responsible because it allegedly continued to make calls despite his explicit demand to stop and unlawfully utilized an automatic telephone dialing system or an artificial or pre-recorded voice.
Hahn requests a trial by jury and seeks judgment against defendant, statutory damages, interest and further relief as may be just. He is represented by Mark D. Molner of Price Law Group APC in Kansas City.
