ST. LOUIS — Labor organizations are suing CCR Construction Inc., citing alleged breach of contract.
St. Louis-Kansas City Carpenters Regional Council, Carpenters’ Pension Trust Fund of St. Louis, Carpenters’ Health and Welfare Trust Fund of St. Louis, Carpenters’ Vacation Trust of St. Louis et al. filed a complaint in the U.S. District Court for the Eastern District of Missouri against CCR Construction Inc. alleging that the employer breached its duty of good faith and fair dealing.
According to the complaint, the plaintiffs allege that they have suffered damages resulting from the defendant's failure and refusal to pay its obligated contributions to union funds, forward to the union all deducted dues and provide the funds offices with monthly statements pursuant to trust agreements that the defendant entered into for the benefit of the plaintiffs. The plaintiffs hold CCR Construction responsible because it allegedly failed to fulfill its obligations under an agreement by failing to pay the required contributions and forward all deducted dues and monthly statements.
The plaintiffs request a trial by jury and seek judgment in favor of plaintiffs, pay for delinquent contributions, plus liquidated damages and interest, submission of its books and records for an audit and submission of the required monthly statements, as well as attorneys' fees, costs and further relief as the court may deem just.
